RAFFLE DATES AND TIMES:
Tickets will be sold from August 28, 2008 through November 12, 2008 at 5 p.m. One (1) Grand Prize Winner and one (1) Stand By Winner will be selected and formally announced on November 18, 2008, 7:00 PM. at the drawing celebration event hosted by Potamkin Honda, 2150 NE 163 St., North Miami Beach, Fl. Potential Grand Prize Winner or Stand By Winner need not be present at the time of drawing to win. At least one representative from each participating charity, school, synagogue, church or tax-exempt organization must be present. The potential Grand Prize winner will be notified first by telephone and then by Certified Mail within seven days of the drawing. The potential Grand Prize winner will have 15 days from date of drawing to complete their claim and accept delivery in accordance with the Official Rules. Should the Grand Prize Winner forfeit the Grand Prize or be otherwise unwilling or unable to accept the Grand Prize, the Grand Prize will be awarded to the Stand By Winner, who shall be notified of their selection within seven days and shall have an additional 15 days to complete their claim and accept delivery in accordance with the Official Rules. All prize winners will be randomly selected from all eligible entries received throughout the sale period. In the Grand Prize drawing, the potential winner of the winner Grand Prize will be selected first; the Stand By potential winner of the Grand Prize will be selected next. Entrants selected as potential winners will be removed from the pool of eligible entries as the Grand Prize Drawing proceeds. As a result, if your Raffle ticket is selected in connection with the award in the Grand Prize Drawing that same Contest ticket will not be eligible to be selected as Potential Stand By Winner in the Grand Prize Drawing. All random drawings will be supervised by an accounting firm.
GRAND PRIZE:
One Grand Prize will be awarded. The Grand Prize consists of a 2008 Honda Fit donated by Potamkin Honda. The automobile must be delivered to and accepted by the Grand Prize winner no later than December 10, 2008 , or the winning ticket Grand Prize Winner will forfeit the prize to the Stand By Winner. The automobile shall be retail delivered to the winner only at Potamkin Honda in North Miami Beach, Florida. Winner must also execute any documents necessary to take title to such automobile. If the Winner does not want to accept the prize vehicle or other prizes as applicable, there will be no substitution or exchange for cash or other goods. Winner must have proper identification when claiming the automobile (i.e., a valid state driver's license) and appropriate insurance. The Winner is responsible for all other costs associated with the acquisition and award of the vehicle, including all applicable Income Taxes. license and registration fees, if applicable. Potamkin Honda will issue a 1099-MISC to Winner reflecting retail value of the prize. sales or luxury tax, license and registration fees, if applicable. The vehicle will not be delivered until after all of the applied taxes, license and registration fees are paid by the Winner. Delivery of the 2008 Honda Fit shall be made as soon as practical after the drawing, but in no event more than eight (8) weeks after the Grand Prize Winner or Stand By winner executes the prize claim documents (as defined below). All winners will be called by name and verified by matching the ticket with information on the winning ticket stub.
ELIGIBILITY:
Raffle ticket purchasers must be 18 years of age or older. No employees or family members of employees of Potamkin Honda or employees of the participating charities, schools, synagogues, churches or tax-exempt organizations are eligible to participate. Prize winners will be required to submit a signed affidavit of eligibility, photo identification, taxpayer identification number and other identifying information or else will be deemed ineligible to claim the prize. Named ticket-holders may not be changed.
RAFFLE PUBLICITY:
Raffle participants and the Grand Prize winner/Stand By Winner agree by their participation that the Aventura Marketing Council, Potamkin Honda or any of the participating charities, schools, synagogues , churches or tax-exempt organizations will be able to use their name and/or likenesses for media including television, radio, web and print.
ENTRY:
Only one Grand Prize will be awarded. Increased volume of ticket sales will lower the odds of winning the Grand Prize. The IRS has taken the position that amounts paid for chances in Raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions.
TICKET ORDERS:
Tickets will go on sale on August 28, 2008 at 9 AM . Suggested donation per ticket is $20, and tickets may be purchased from any of the participating charities, schools, synagogues ,churches or tax-exempt organizations. Check the participating organization's website or www.aventuramarketingcouncil.com for details. You may buy as many tickets as you wish, subject to availability. Raffle ticket orders, where accepted by participating organizations, must be accompanied by valid credit card numbers, expiration dates and card holder signature. The participating organizations will reject any raffle ticket order if the credit card payment is not honored or returned for insufficient funds. Ticket receipt(s) will not be mailed to the named ticket-holders who purchase tickets online. Credit card receipt serves as proof of entry. Participants who purchase tickets at promotional event will receive a formal receipt of purchase. Tickets may not be changed, sold or transferred by the purchasing party to anyone else without the express written approval of Potamkin Honda in its sole discretion.
REFUNDS:
All Raffle ticket sales are final. No refunds will be made except under the following circumstances: any ticket order with payment received after November 12, 2008 will be returned. No other refunds are available.
LIMITATION OF LIABILTY:
Potamkin Honda, the Aventura Marketing Council and all participating organizations (Released Parties) are not responsible for any incorrect or inaccurate information, including, without limitation, that which is caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Raffle or by any technical or human error which may occur in the processing of entries in the Raffle. Released Parties assume no responsibility for any error, omission, interruption, deletion, or defection, delay in operation or transmission, communications line failure, theft or destruction unauthorized destruction or unauthorized access to, or alteration of web site or entries in processing the Raffle entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of email or entrants on accounts of technical problems or traffic congestion on the Internet or at any web site associate with the Raffle. Released Parties are not responsible for user cheating or fraud by any entrants. If, for any reason, the Raffle is not capable of running as planned, including, without limitation, unauthorized intervention, fraud, technical failure or for any other causes beyond the control of Potamkin Honda, the Aventura Marketing Council or the participating organizations, or could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Raffle, Potamkin Honda and the Aventura Marketing Council, in their sole discretion, may cancel the Raffle and return/refund all entries or select the winner in a random drawing comprised of all eligible.
RELEASED PARTIES SPECIFICALLY DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, REGARDING THE AUTOMOBILE. ANY WARRANTY ACCOMPANYING THE PRIZE SHALL BE LIMITED TO THE MANUFACTURERS WRITTEN EXPRESS WARRANTY, IF ANY.
In no event shall Released Parties , their directors, officers, employees, agents or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages. A Raffle participant's sole and exclusive remedy for breach shall be limited to the return of the purchase price paid for his or her Raffle ticket(s).By entering this Raffle, participants agree to be bound by these Official Rules and the decisions of Potamkin Honda and the Aventura Marketing Council, which are final and binding in all respects. Potamkin Honda and the Aventura Marketing Council reserve the right at their sole discretion to cancel, terminate, modify or suspend the Raffle.
GOVERNING LAW/JURISDICTION:
All issues and questions concerning the construction, validity or enforceability of these Official Rules or the rights and obligations of the participants shall be governed by and construed in accordance with the internal laws of the State of Florida without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any law other than that of the State of Florida. The invalidity or unenforceability of any provision of these Rules shall not affect the validity of any other Official Rule. Each person who participates in the Raffle, agrees that the exclusive venue for the resolution of any dispute or legal question shall be in the Circuit Court of the Eleventh Judicial Circuit in and for Miami-Dade County Florida and waives any right to proceed in any other jurisdiction.
